Terms of Service

ACCEPTANCE OF TERMS THROUGH USE

By using this site, you signify your agreement to all terms, conditions, and notices contained or referenced herein (the “Terms of Service”). If you do not agree to these Terms of Service please do not use this site. We reserve the right, at our discretion, to update or revise these Terms of Service. Please check the Terms periodically for changes. Your continued use of this site following the posting of any changes to the Terms of Service constitutes acceptance of those changes.

REFUND POLICY

Except under the circumstances outlined below in our Training Guarantee, Gene Lonsway, NC Dogs LLC DBA Chapel Hill Boarding Kennel, and New Hope Dog Training Center does not grant refunds. All sales are final.

TRAINING GUARANTEE

At New Hope Dog Training Center we offer an absolute money-back guarantee on our three week in-board training program.

Our policy is simple. If at the end of your program your dog is not significantly calmer and more obedient than before our training, and you actively participated in your classes, you may ask for a refund of your tuition.

All you have to do to qualify for a refund is:
1. All adult family members who handle the dog must actively participate in and complete all of the lessons as scheduled. For remote lessons conducted via Zoom or similar platforms, participants are required to have their cameras on throughout the session to confirm their attendance and active participation, without exception.
2. Get your written request for a refund to us within 30 days of your dog’s return home.
This guarantee applies only to our 3 week obedience program. Dogs with any history of aggression towards animals, other dogs, or people are exempted from this guarantee. This guarantee is limited to one dog per household.

RESCHEDULING POLICY

We strongly discourage any rescheduling once we have agreed upon a date for your dog's drop off. Should you need to reschedule your drop off, a fee of $200 will be assessed if the rescheduling occurs within 7 days of the originally scheduled drop off date.

RECORDING POLICY

You agree not to record, whether by video, audio, transcription, or any other means, any portion of the program content, including but not limited to lectures, discussions, presentations, and video meetings. You are strictly prohibited from distributing, sharing, uploading, or making available any program content to any third party, including but not limited to peers, colleagues, and online platforms or forums. Any breach of these provisions may result in immediate removal from the program without refund, legal action, and other remedies available under the law. NC Dogs LLC reserves the right to seek damages and other appropriate relief for any unauthorized use or distribution of program content.
DISCLAIMER OF WARRANTIES

ALL MATERIALS, INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THIS SITE (THE “CONTENT”) ARE PROVIDED “AS IS” AND “AS AVAILABLE” FOR YOUR USE. INDEMNIFICATION

Upon a request by NC Dogs LLC, you agree to defend, indemnify, and hold harmless NC Dogs LLC and its subsidiary and other affiliated companies, and their employees, contractors, officers, and directors from all liabilities, claims, and expenses, including attorney’s fees, which arise from your use or misuse of this site. NC Dogs LLC reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with NC Dogs LLC in asserting any available defenses.

CHOICE OF LAW AND FORUM

These Terms of Service shall be governed by and construed in accordance with the laws of the state of North Carolina, excluding its conflicts of law rules. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to these Terms of Service or your use of this site shall be filed only in the state or federal courts located in the state of North Carolina, and you further agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action.

SEVERABILITY AND INTEGRATION

Unless otherwise specified herein, this agreement constitutes the entire agreement between you and NC Dogs LLC with respect to this site and supersedes all prior or contemporaneous communications and proposals (whether oral, written, or electronic) between you and NC Dogs LLC with respect to this site. If any part of these Terms of Service is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.

AMENDMENTS TO THIS AGREEMENT AND CHANGES TO TERMS

NC Dogs LLC may revise our Terms of Service Agreement at any time by updating this page. Changes will be binding on the date they are posted on this page. Any use of NC Dogs LLC will be considered acceptance by you of the then-current Terms of Service. If at any time you find the Terms of Service unacceptable, you may not use the Site any longer. Any new or different terms supplied by you are specifically rejected by NC Dogs LLC unless NC Dogs LLC agrees to them in a signed writing specifically including those new or different terms. NC Dogs LLC may change the Site at any time.
